カツオ武士(P)製作モデル　オンライン規約（日本語）

この規約は以下のモデルに適用されます。
これらのモデルを使用する場合、必ずこの規約に同意する必要があります。
以下のモデルに該当しない製作モデルは個々の利用規約にしたがって使用してください。

再配布可能モデル（以下、Aモデル）※項目2、3を参照

1：免責事項
・この規約は予告なく更新されることがあります。規約内容を更新した場合、何らかの手段（主にTwitter）を用いて報告を致します。しかし更新を利用者全員に伝えることは不可能なため、もし更新された規約内容を確認しなかった場合でも、モデル使用を継続した時点で更新した規約に同意したものとします。
・製作者はこの規約で禁止されている行為を行う場合があります。
・製作したモデルを使用した際に生じた不具合等に対しては、一切の責任を負いません。
・配布しているモデルは、製作者の都合で配布を停止、または使用禁止にする場合があります。
・英語翻訳規約とこの日本語規約の間に解釈の違いがあった場合、規約の解釈は日本語規約に順守します。

2：禁止事項
※以下の禁止事項は、条件によって許可する場合があります。
※モデルデータは、ポリゴンデータ、テクスチャデータ等、配布しているデータ全てを含みます（ただし、PMX/PMD/X内部データのうち、情報、材質、ボーン、モーフ、表示枠、物理演算の設定は含みません）。
・以下2つのどちらにも該当しない行為（2に該当しない場合は事前連絡必須）

  1. A/Bモデルデータの一部または全体を含むデータを最終的にレンダリングしているソフトがMMD、または関連ソフト（MMM、PMXE等）であるか、MMDBridgeを使用してレンダリングしている。
  2. A/Bモデルデータの一部または全体を含むデータをMMD、または関連ソフト（MMM、PMXE等）で作品を制作する目的で使用している。

　※禁止行為例：
　→ゲーム、ニコニ立体等での使用
　→A/Bモデルデータの一部をゲームで使用する別モデルに利用する。
　→A/Bモデルデータを改造したモデル、または利用した別モデルをゲームで使用する。
　※許可行為例：
　→MMDから出力した動画、静止画をインターネット上にアップロードする。
　→MMDから出力した動画、静止画をゲームやソフトウェア等で使用する（事前連絡必須）。　→A/Bモデルデータを改造したモデル、または利用した別モデルをMMDで使用する。

・政治目的、誹謗中傷目的での使用
・A/Bモデルデータの一部または全体を含むデータの再配布（Aモデルに限り、事前連絡があれば許可します。「3：Aモデルの再配布」を参照してください。）
・A/Bモデルデータの一部または全体を含むデータ、またはそれらを使用した動画や静止画の販売
・A/Bモデルデータの権利者、または製作者を偽る行為
・規約違反者のモデル使用

3：Aモデルの再配布
「2：禁止事項」に該当していない上で、以下のことを行っている場合のみ許可を出します。ただし事前に連絡がなかった場合は、以下のことを行っていても許可を出しません。
・ベースがAモデルであり、そのモデル、テクスチャ等の一部を改変している（ただし、モデルの一部のみをベースに改変したものは認めません）。

　※禁止行為例：
　→B747モデルからエンジン部分のみを取り外し、それを改変し再配布する。
　※許可行為例：
　→B747モデルを改造し、他の派生機体を再配布する。
　→B747のテクスチャを改変し、別航空会社の塗装にする。

・モデル製作者に「カツオ武士(P)」の記載がある。
・この規約への誘導が存在する。
・再配布用説明書がある場合、それを同封している。

4：規約違反
「3：禁止事項」に該当する行為を行った場合、違反者に対して警告を行います。
警告後1週間以内に改善が見られない場合、製作モデル全ての使用を禁止させていただきます。

1: Disclaimer
-This terms of use may be renewed without notice. When the terms of use is renewed, I inform you about renewal in some way (mainly Twitter). But I can’t inform all of user, so even if you don’t check new rules, I consider you agree to new rules when you continue to use my models.
- I may do things are prohibited in this rule.
- I don’t take responsibility for any damages caused by using my models.
- I may stop distributing or prohibit to use my models for my own reason.
- When there are some different interpretations between English rule and Japanese, interpretations of rule will follow Japanese rule.

2: NOT Allowed things
#The following prohibition may be permitted as long as you meet requirements. Please contact me in advance.
#Model data mean all data I’m distributing (polygon data, texture data, etc). (But Model data do not include Info, Material, Bone, Morph, Display Pane, Physics settings of PMX/PMD/X files.)
- Things fulfilling neither of two following requirements. (If things don’t fulfill No.2, you should contact me in advance.)

  1. Software render a part or the whole of data including A/B-Models’ data finally is MMD or related software (MMM, PMXEditor, and so on). Or A/B-Models’ data are rendered using MMDBridge.
  2. Using a part or the whole of data including A/B-Models’ data for making works using MMD or related software (MMM, PMXEditor, and so on).

#NOT Allowed:
-> Using models in games, NicoNiRittai (model data uploading service) and so on.
-> Using a part of A/B-models’ data for other models are used in games.
-> Using models using A/B-models’ data in games.
#Allowed:
-> Uploading videos or pictures output from MMD on the Internet.
->Using videos or pictures output from MMD on games or software (Contact me in advance).
-> Using models including A/B-models’ data in MMD.

- Using A/B-Models for political campaign or slander.
- Redistributing a part or the whole of data including A/B-Models’ data. (But you can redistribute A-Models as long as you meet requirements. Please look “3: Redistributing A-Models”.)
- Selling a part or the whole of data including A/B-Models’ data, or selling videos and pictures use that.
- Pretending right holder or model maker of A/B-Models’ data.
- The violators of this rules use my models.

3: Redistributing A-Models
If you don’t break “2: NOT Allowed things”, I will permit you to redistributing A-Models as long as you do the following requirements.
- Base model is A-Model and making some changes in it or its textures. (But I won’t permit you if base model is a part of A-Model.)

#NOT Allowed:
-> Taking engines of B747 model, making some changes in it and redistributing it.
#Allowed:
-> Making derived aircrafts of B747 models and redistributing them.
-> Making other airlines’ paintings of B747 models’ texture and redistributing them.

- Writing name of “カツオ武士(P) or katsuobusi24” as original model maker.
- Existing a guide to this terms of use.
- If my model has manual files for redistribution, enclosing it with your redistribution files.

4: Violation
When you do prohibited actions (written in “2: NOT Allowed things”), I will warm you first. If you continue to do prohibited actions more than a week after I warm, I will ban you from using my all models.
